Nexus 7 ME370T Power Button Problem topic

I recently purchased a Nexus 7 off Ebay , said it was in "NEW " condition , it is in "New Condition" however the power button seems abit too sensitive , almost as if its a touch sensitive button. The volume buttons are normal but the power button doesnt press in , however if I touch it slightly it will turn on and turn off , standby and lock but this is all done by the slightest of touches like touching the touch screen , you don't press it you just touch.
The seller tells me that this model ME370T does not have a power button which you can press and that its not faulty. Google tells me that they haven't included touch sensitive buttons but the button is a shallow button and I might be pressing it without noticing . I dont know what to do because if its not faulty then the tablets perfect however if it is faulty then it will be the 2nd tablet I have returned to ebay in 1 week.
